Until now, animals have been regarded in the Civil Code as movable physical matter.A new bill aims at the design of a new category of 'animals', which is apart from 'people' and 'goods'. Property law therefore continues to apply to animals, but subject to animal protection regulations. Although animals remain tradable, they are not identical to inanimate objects.
The animal rights organization GAIA expressed their support of this bill and is continuing with its campaign for the constitutional protection of animals.
Belgium would not be the first country to anchor the protection of animals in the Constitution. Germany, Luxembourg and Slovenia, among others, already have done so.
