Implementation of the EU Nitrate Directive: joint declaration by BMU and BM

After the amendment to the Fertilizer Ordinance, which has been in force since May 1, 2020, the amendment to the General administrative provision was the last necessary step at the federal level to implement the EU Nitrates Directive in Germany. The General administrative provision is due to come into force at the end of September 2020. It is now the responsibility of the federal states to review and adapt their territorial designations and to revise the state fertilizer regulations by the end of 2020. With the implementation by the federal states and the already completed amendment of the Water Management Act, the June 2018 ruling of the European Court of Justice will be fully implemented.

In accordance with the specifications of the amended Fertilizer Ordinance of 2020, the federal states will receive extended technical principles in order to revise and redesign nitrate-polluted and eutrophicated areas. The general administrative regulation also lays down the requirements for the uniform designation of these areas. Qualitative requirements for the monitoring stations are laid down and the monitoring station network must be adapted by the federal states. The procedure for the binding internal differentiation is uniformly defined. Thus, the polluter-pays principle is increased. The Federal Government is also supporting the proper implementation of the European Nitrates Directive with nationwide monitoring from mid-2021.

All nationwide measures from the amended Fertilizers Ordinance will apply from the time the new ordinance comes into force on May 1, 2020, while the additional measures in nitrate-polluted and phosphorus-eutrophicated areas will apply from January 1, 2021.
